Warning: Document misusing the name of JMW Solicitors LLP and Mark Gilmartin

A 'Sworn Affidavit of claim/support' has been sent to a member of the public purporting to be prepared by 'MW Solicitors LLP' and signed by 'Mark Gilmartin'.

What is the scam?

The SRA has seen a document titled 'Sworn Affidavit of claim/support', which purports to be prepared by the genuine firm of solicitors JMW Solicitors LLP and purports to be signed by the genuine solicitor Mark Gilmartin. The document also quotes a genuine firm address of ‘Kings House, 36-37 King Street, London, EC2V 8BB, England’ (see below).

Is there a genuine firm or person?

The SRA authorises and regulates a genuine solicitor called Mark Gilmartin, whose SRA ID number is 535323.

The genuine solicitor Mark Gilmartin has confirmed that they do not have any connection to the document referred to in the above alert.

The SRA also authorises and regulates a genuine law firm called JMW Solicitors LLP, whose SRA ID number is 508380.

The genuine firm has confirmed that they do not have any connection to the document referred to in the above alert.

What should I do?

When a firm's or individual's identity has been copied exactly (or cloned), due diligence is necessary. If you receive correspondence claiming to be from the above firm(s) or individual(s), or information of a similar nature to that described, you should conduct your own due diligence by checking the authenticity of the correspondence by contacting the law firm directly by reliable and established means. You can contact the SRA to find out if individuals or firms are regulated and authorised by the SRA and verify an individual's or firm's practising details. Other verification methods, such as checking public records (e.g. telephone directories and company records) may be required in other circumstances.
