Reasons/basis
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Mr Lillywhite :-
- In February 2023, created and backdated, (or caused the creation and backdating of) a document to 13 December 2022 on the matter of Client A, which gave the misleading impression that the document had been signed on an earlier date when this was not the case.
- On 3 March 2023, sent an email to Client B which he knew or ought to have known was misleading, as he omitted to tell Client B that a draft Will had been sent to the client’s previous address instead of the client’s new address.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

Decision details
Mr Lillywhite's practising certificate for 2023/2024 is subject to the following condition:
- Mr Lillywhite may act as a solicitor only as an employee and only where that employment has first been approved by the SRA.
In this condition the terms are as defined in the SRA Glossary.
Reasons/basis
The above interim condition is made under rule 3.2 of the SRA Regulatory and Disciplinary Procedure Rules, which states that at any stage an authorised decision maker may, pending a final decision by the SRA or the Solicitors Disciplinary Tribunal, impose interim condition(s) on the practising certificate of a solicitor. We are satisfied that this condition is necessary in the public interest or for the protection of the public.
